1. Acceptance of Terms

By downloading, installing, or using the BloomScan mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms form a legally binding agreement between you and Macadamia LLC ("we," "our," or "us").

2. Eligibility and Age Requirements

If you are between 13 and 17 years old, you represent that your parent or legal guardian has reviewed these Terms and consents to your use of the App, including the submission of facial photos for AI analysis. We do not permit use of the App by anyone under 13. If we discover that a user is under 13, we will terminate their access and delete any associated data.

3. User Accounts

BloomScan offers an optional Sign In with Apple feature. If you choose to create an account, you must provide accurate information, are responsible for maintaining the security of your device and Apple ID, and must notify us immediately at bloomscanhelp@gmail.com if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms. You may also use the App without an account — in that case, all data is stored locally on your device only.

4. Permitted Use

BloomScan is licensed to you for personal, non-commercial use only, solely for its intended purpose: capturing and analyzing facial photos for personalized beauty and skincare guidance.

5. Prohibited Conduct

You agree not to:

• Use the App if you are under 13 years of age
• Submit photos of any person other than yourself without their explicit consent
• Submit photos of minors (users under 13) for AI analysis
• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, decompile, or tamper with the App or its source code
• Transmit harmful, offensive, or illegal content through the App's chat feature
• Use automated tools, bots, or scripts to interact with the App
• Impersonate any person or entity
• Attempt to circumvent any paywall, subscription verification, or access control

6. Camera Use and AI-Powered Features

Face Scanning

By using the scan feature, you grant BloomScan permission to access your camera, acknowledge that your photo and beauty profile are transmitted to Anthropic, Inc. for processing, and agree not to submit photos of individuals under 13 or of other people without their explicit consent.

AI Beauty Advisor Chat

Your messages, photos shared in chat, and beauty profile are transmitted to Anthropic's API. The chat is intended for beauty and skincare-related guidance only and is not a substitute for professional medical or dermatological advice.

7. Subscription and In-App Purchases

• Subscriptions are auto-renewing and processed through Apple's App Store
• Payment is charged to your Apple ID upon confirmation of purchase
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the billing period
• Manage and cancel your subscription anytime in iOS Settings under your Apple ID
• All purchases are final — refunds are handled per Apple's refund policy at support.apple.com/billing
• We reserve the right to change subscription pricing or features with reasonable advance notice

8. Intellectual Property

All content, features, and functionality of the App — including the BloomScan name, logo, design, user interface, and software — are the exclusive property of Macadamia LLC, protected by applicable copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App on your personal iOS device for personal, non-commercial purposes only.

9. User-Submitted Content

You represent that you own or have the right to submit any content you provide, that your content does not violate any third-party rights, and that it does not contain illegal, harmful, or offensive material. You retain ownership of content you submit, and grant us a limited license to transmit it to Anthropic solely as necessary to provide the App's AI features.

13. Indemnification

You agree to indemnify and hold harmless Macadamia LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses arising out of your use of the App, violation of these Terms, submission of content that violates third-party rights, or violation of any applicable law.

14. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice. Grounds include violation of these Terms, fraudulent activity, or abuse of the App's features. Upon termination, your right to use the App immediately ceases.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Utah, without regard to conflict of law provisions. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Davis County, Utah. You consent to the personal jurisdiction of such courts.

16. International Users

BloomScan is available globally. If you use the App from outside the United States, you are responsible for compliance with local laws. For EU and UK users, nothing in these Terms limits any rights you may have under applicable consumer protection or data protection law.

17. Severability

If any provision of these Terms is found to be unenforceable, that provision will be limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Macadamia LLC regarding your use of the App.

19. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via an in-app notice. Continued use of the App after changes are posted constitutes your acceptance.
